Electrical safety on rental property is mandatory. Five year EICR Electrical Inspection, on all fixed appliances and wiring will become mandatory from 1st July 2020 for all new tenancies.  Failure to comply will result in a fine of up-to £30,000.  Existing tenancies will also take effect from 1st April 2121

Qualified Electrician

A ‘qualified person’ must be employed to carry out the tests.  This competent person will undertake the inspection and testing required, and further investigative or remedial work.  Any improvement work will need to be done within 28 days or as recommended by the inspector, and provide the Private Landlord with a written EICR certificate with a copy given to the tenant.

Remedial Notices when in breach

The council can serve a remedial notice on the Private Landlord if in breach of the requirements.  If the work is not carried out, the local authority can access the property with the tenants permission to do the work although there is an appeal system.  They will also look to recover the costs of the works and as mentioned earlier, issue a fine of up-to £30,000.  If a Tenant refuses access, the Landlord will not be considered to have breached this duty.

Providing compliance document to tenant’s

For new tenancies, a copy of the report should be provided at check-in.
